Capital Gains Tax When Selling Property

Whether a property sale creates Capital Gains Tax depends on the gain, your circumstances and available reliefs. Do not assume that every sale is taxable or that a quick sale removes a reporting requirement.

Reporting and payment

HMRC says tax due on UK residential property must be reported and paid within 60 days of completion. For UK residents, whether a return is needed depends on the gain and applicable reliefs or allowances. Non-residents must report UK property or land disposals even where no tax is payable. Check the rules for your circumstances.

Information to prepare

Keep purchase and disposal dates and values, relevant acquisition and sale costs, improvements, ownership shares and evidence for any relief claimed. Joint owners report their own position.

Obtain tax advice

A tax adviser can assess residency, reliefs, ownership and any estate or trust issues. Check whether Self Assessment reporting is also needed. Investor pricing and Lucennio’s no-seller-fee policy do not determine your tax liability.

Check whether main-home relief applies

Private Residence Relief can cover gains on a qualifying main home, but the result depends on how the property was owned and used. Letting, periods living elsewhere, business use or another home can affect the calculation. Use HMRC’s guidance and give your adviser a timeline rather than assuming that having lived there once settles the tax position.

Mortgage proceeds and taxable gain are different

The cash left after repaying a mortgage is not the same as the taxable gain. HMRC generally starts with acquisition and disposal values, then considers allowable costs and reliefs. Its guidance distinguishes improvements from normal maintenance and says purchase-loan interest cannot be deducted from the gain. Ask your adviser which records and valuations apply if the property was inherited or transferred.

Agree who will handle the reporting

Before completion, ask your tax adviser what information they need, whether they will submit any return and how payment will be arranged. Keep their agreed tasks and dates in writing. Do not assume that appointing a conveyancer includes tax advice or reporting. If you are a joint owner, personal representative, trustee or company, explain that role at the start so the appropriate process is checked.
