Selling a House During Probate
Selling an estate property requires the right authority and a considered decision about the estate’s interests. An investor introduction is one possible route, alongside an estate agent or auction; it cannot bypass estate administration.

Discuss my propertyEstablish who can sell
Ask the estate’s solicitor to check ownership and who has authority to act. In England and Wales a grant may be needed where the deceased owned the property alone; joint ownership can change the position. Scotland and Northern Ireland have different procedures. Do not assume every inherited property follows the same process.
Marketing and completion
GOV.UK advises waiting for probate before putting estate property on the market or making financial plans. Ask the estate solicitor whether probate is required for this ownership and what authority is in place. Establish the position before marketing, accepting terms or promising a completion date.
Compare the net outcome
An investor may consider a property needing repairs or clearance. Compare the offer with independent valuations and other selling routes, including costs, conditions and timing. The estate’s representatives should consider their duties and obtain advice on disagreements or competing interests.
Prepare information securely
Gather the title information, grant or other authority where required, mortgage details, condition reports and insurance arrangements. Keep an empty property appropriately insured. Our initial form needs only basic contact information; do not upload estate documents or identity records.
Separate estate administration from a sale decision
Establish whether you are selling as a personal representative or as someone who already owns an inherited property. These are different starting points. Ask the estate solicitor to identify who can give instructions and sign documents. Keep a written record of what remains outstanding before setting a marketing or completion timetable.
- Who is the registered owner, and is a grant or other authority needed?
- Who is responsible for the estate valuation and any tax work?
- Are there other representatives or unresolved instructions that affect the decision?
- Who will arrange access, insurance and ongoing property bills while the sale is considered?
Build a comparison the estate can review
For each proposed route, record the suggested price, clearance or repair costs, agent or auction terms, buyer conditions and likely next step. A higher headline offer with unresolved funding is different from a lower offer with fewer conditions. Neither proves which choice is right for the estate. Keep valuations and written proposals for the representatives and their advisers to assess; do not describe an illustrative offer as an independent valuation.
