Selling a House with Tenants in Situ
A tenanted sale transfers a property with an existing letting arrangement; it does not automatically end the occupier’s rights. Decide whether you are exploring a sale with tenants in place or seeking vacant possession, then obtain advice for the property’s jurisdiction.

Discuss my propertySelling with tenants in place
Provide accurate tenancy, rent, deposit and compliance records to your solicitor and prospective buyer through a secure process. A buyer needs to understand obligations, arrears or disputes and any restrictions. Discuss access respectfully and follow the applicable tenancy arrangements.
Seeking vacant possession in England
For affected private tenancies in England, new Section 21 notices ended on 1 May 2026. A landlord wishing to sell may need to use an applicable possession ground and meet its conditions. Ground 1A has a four-month minimum notice period and a protected initial period; notice does not itself guarantee the date possession is obtained. Transitional cases need specific advice.
Other UK jurisdictions
England’s possession rules are not a UK-wide procedure. Wales, Scotland and Northern Ireland have different tenancy regimes. Consult the relevant official guidance and a suitably qualified adviser before issuing notice or agreeing a completion date dependent on possession.
Investor suitability
An investor may consider the tenancy, achievable rent, property condition, compliance and funding. Lucennio can discuss a possible introduction but cannot guarantee a buyer or vacant possession. Sellers pay no fee to us.
